Good afternoon Ms. Galea,
On 3/28/17, we received your request to inspect:
- All of the Interrogatories and requests for admissions that were served upon the City of Albuquerque or the Albuquerque Police department in association with Second Judicial District Court Cause No. 202-CV-2014-04372.
- And all documents that were considered by the City at the time the city decided to enter into the settlement agreement in the above referenced cause of action.
As we previously mentioned your public records request was deemed to be excessively burdensome and broad, however, we have also made available a significant amount of non-exempt responsive records. In addition to those documents, the City now has all of the additional documents reviewed and the remaining non-exempt public records responsive to March 28 request are available for your inspection or copying. At your request, the City can determine the exact number of pages of additional records and can provide you an invoice. As was previously mentioned if you wish to purchase copies it is $0.50 per page. These documents are available at the City Clerks Office located at 600 2nd St. NW, Suite 720, Albuquerque, NM 87106. Please contact Kathleen Oney, IPRA / Codification Specialist Office of the City Clerk, at 924-3657 to set an appointment to inspect/purchase the documents.
Finally, the City has determined that some of the responsive records to your public records request are exempt from disclosure under the Inspection of Public Records Act, including under NMSA 1978, Section 14-2-1(A)(3) (“matters of opinion”), Section 14-2-1(A)(4) (“confidential law enforcement records”); Section 14-2-1(A)(8) (“otherwise provided by law”) including, but not limited to Rule 11-503 NMRA (Lawyer-Client Privilege), and Rule 1-26 (Attorney Work Product).
