Thank you for your latest communication, we appreciate you mentioning  that non-redacted documents were made available to you. If you still maintain a copy of the non-redacted documents then we respectfully request that you shred or otherwise destroy those records as they contain protected personal identifier information. Please keep in mind the decision to allow you to personally inspect the remaining responsive documents is allowed for under IPRA. Furthermore, the City is simply granting your request from your original IPRA communication, in which you state "Any records not available electronically, I can come to a location you designate and scan them (as I have done with State agencies)." You previously indicated your willingness to come to the location where the documents are located. If you are now unwilling, then please indicate as such. However, that still does not change the fact that the City is in compliance with IPRA for the records located at Montessa Park. It is now up to you come personally inspect these records. 

 

As you are likely aware, IPRA says it is "the responsibility of a public body to make available public records for inspection." NMSA 1978, Section 14-2-7(E)(5). The City has accomplished this requirement by making the records at Montessa Park available to you. We also have rightfully informed you that you will not be able to scan any of the responsive records that you wish to have an electronic or paper copy of, unless and until the document is first reviewed by City staff to ensure no protected personal identifier information is found. And if any such information is found then a redacted copy with be made. The City is authorized to charge you for any copying costs (see Section 14-2-7(E)(4)), however, we are willing to waive those potential copying costs if you follow the procedures set forth above, and as long as the documents that you seek a copy of whether electronic/paper are not excessive in number as determined by the City.
