On June 27, 2017, we received your public records request for the following records:
Any lapel camera video and suspect and witness interview video from the incident that took place on 8-24-2016 wherein Victoria Martens was killed. Please fill this IPRA as items become available and also please consider this IPRA as a standing open request until all items are fulfilled.
We cannot permit inspection of these records because they are exempt from disclosure under IPRA, NMSA 1978, § 14-2-1(A)(4) (confidential law enforcement records); and NMSA 1978, § 14-2-1(A)(8) (otherwise provided by law). If made public the requested records would seriously interfere with the effectiveness of a criminal investigation or prosecution. Additionally, the records of the videos detail the methods and procedures a law enforcement agency follows when investigating crimes; the records contain evidence that, if disclosed, would alert potential defendants to destroy evidence, coordinate stories, or flee the jurisdiction; records contain witness testimony that is crucial to a criminal investigation or prosecution; record contain information that might unfairly cast suspicion on and invade the privacy of innocent people or endanger a person’s life.
