Torres Consulting and Law Group, LLC (“TCLG”) submits this request under the Inspection of Public Records Act (“IPRA"), NMSA 1978, §§ 14-2-1 to -12. The disclosure of the requested information is likely to contribute significantly to the understanding of the public at large and is not made to further a commercial interest.
We formally request copies of the following documentation for the Innovate ABQ-Lobo Rainforest Bldg. project referenced above.
- Notice to Proceed
- Labor Clauses within the Awarding Contract, including Public Works Minimum Wage Act (PWMWA) requirements and Davis-Bacon and Related Acts (DBRA) requirements
- Signed Statements of Intent to Pay Prevailing Wages
- NM Department of Workforce Solutions Designated Wage Rate Decision, incorporated into the Contract
- All certified payrolls related to any and all insulator work, including but not limited to, rate of pay, worker classification fringe benefits paid, hour’s worked, etc. covering work performed from the start of construction to current.
The primary interest in obtaining this information is to protect the living standards for all working families. The information requested will assist in ensuring that contractors are accurately
compensating workers on federal and state funded projects based on the statutory requirements outlined under the DBA and PWMWA.
Furthermore, the disclosure of the information will establish the degree to which contractors on federal and state funded construction projects comply with the DBA and PWMWA. Consequently, certified payroll, names of contractors, wage modifications, project schedules, wage determinations, contract amounts, names of apprenticeship programs, and other related information is critical to informing the public of the government’s responsibility to monitor compliance of the prevailing wage regulations. After analyzing project documents, we send any compliance issues discovered to the attention of the U.S. Department of Labor and/or the New Mexico Department of Workforce Solutions.
