On December 11, 2017, we received your public records request for the following records:
I would like to request police reports, crash report, diagrams, video/photos and all other materials associated with the incident that occurred on November 6, 2017, in Albuquerque on Juan Tabo and Menaul involving Cheol Kim.
We cannot permit inspection of these records because they are exempt from disclosure under the New Mexico Inspection of Public Records Act, NMSA 1978, Section 14-2-1(A)(4) (confidential law enforcement records) and (A)(8) (as otherwise provided by law). If made public the requested records would seriously interfere with the effectiveness of a criminal investigation or prosecution. Additionally, if disclosed the records could alert potential defendants to destroy evidence, coordinate stories, or flee the jurisdiction. Further, incomplete investigations contain information that might unfairly cast suspicion on and invade the privacy of innocent people.
When the investigation finishes, these records may be open to the public. We recommend checking every 3 weeks to see if the investigation has finished. Please let me know if you have any questions.
