Hello Mr. Arasim:


First off, thank you for clarifying the scope of your original IPRA request. I appreciate the time you took to respond to my message. As a result of your clarification, the City completed its search for responsive records and the corresponding review of the entire administrative investigation file known as “CPC 101-16”.


This email will acknowledge completion of your public records request dated May 11, 2018 (#18-2664). Please be aware that certain information contained on the responsive public records was redacted pursuant to IPRA. See NMSA 1978, § 14-2-1(B)(Protected Personal Identifiers); NMSA 1978, § 14-2-1(A)(8) (otherwise provided by law) including, but not necessarily limited to, the City of Albuquerque’s Open Records Ordinance, § 2-7-6-1 et seq. ROA 1994, as amended (home addresses).  


I want to also clarify three additional points regarding the records. You are likely aware of this information given the mediation that took place in a previous IPRA lawsuit that you filed caption in D-202-CV-2017-00970, however, I am memorializing this information for the benefit of the City and yourself. First, the CPC complainant (attorney Shannon Kennedy) submitted records along with her complaint, and some of those records contained redactions. As a result, not all of the redactions were made by my office. Second, the Table of Contents used for CPC101-16 was a template. As a result, some of the items listed under “SUBJECT” on the Table of Contents have no corresponding records because the investigation into CPC101-16 was suspended, has not been reopened since it was suspended, and has not been completed. Lastly, you will likely notice a few blank pages in the responsive records. Those blank pages were actually page dividers that were also copied from the complete file known as CPC 101-16. The page dividers present in CPC101-16 do not contain any information, and no information was redacted or exempted from those blank pages.

The inspection may take place either at the aforementioned location, but more likely it will occur at the Office of the City Clerk, located at 600 2nd Street NW, Albuquerque, NM 87102.
