On June 4th, 2018 we received your request to inspect public records.
The following records were withheld pursuant to the New Mexico Inspection of Public Records Act NMSA 1978, Sections 14-2-1(A)(4) and (8) because they are part of an ongoing criminal investigation.
Records pertaining to the ongoing criminal investigation involving the death of Victoria Martens.
Records generated by CYFD and in possession of APD were also withheld pursuant to NMSA 1978, Section 14-2-1(A)(8) (as otherwise provided by law); including but not limited to the Victims of Crime Act (NMSA 1978, §§ 31-26-1 to -10), the New Mexico Constitution art. II, § 24, and the Children’s Code (NMSA 1978, §§ 32A-1-1 to -23-8).
All records responsive to the original request have been produced with the exception of the above exempted records. My office will now close this request.
