On June 7, 2018, we received your public records request for the following records:
— Any communications between the law firm of Kennedy, Kennedy and Ives and the City of Albuquerque legal department, regarding a settlement agreement in case number D-202-CV-2014-03843 from May 7, 2018 through June 7, 2018.
— This includes, but is not limited to emails, letters or text messages regarding the above request for the above time period.
—This also includes, but is not limited to the specifics of the settlement itself.
We cannot permit inspection of these records because they are exempt from disclosure for the following reasons under the Inspection of Public Records Act: including NMSA 1978, § 14-2-1(A)(8) (otherwise provided by law), including but not limited to, the City of Albuquerque’s Risk Management Ordinance § 2-8-2-1, et al. and NMSA 1978, § 15-7-9. The settlement agreement has not been finalized and is considered confidential and exempt from disclosure until the district court approves the agreement. Right now my office does not know how long we will continue to deem the requested records exempt, however, you are welcome to contact me to confirm if the requested records are still deemed exempt. Alternatively you are certainly welcome to resubmit this same request at a later date.
