On July 24, 2018, we received your public records request (identified as #18-4233) for the following records:
This is a formal request under the New Mexico Inspection of Public Records Act. I wish to inspect the following records pertaining to an APD response to a child abuse case at 8200 Bridge Blvd SW #9A11 that occurred on 07/23/2018 that resulted in the arrest Leidy Dahn.
I have attached a criminal complaint filed by APD to assist in locating these records.
The following is what we are requesting:
- All police reports, all accident reports
- All 911 calls, all radio dispatch calls, all photos
- all surveillance, lapel, , dash-cam, and all interviews tagged into evidence for this investigation related to searches, and interviews.
If any of the records are being held in electronic format, I wish to receive electronic copies at email@example.com or, if that is not possible, on a compact disk. If lapel video is released on evidence.com, I would like a download link to be included to download the video. I agree to pay reasonable copy fees according to the city's published fee schedule, but I prefer to be notified in advance if the total cost will exceed $10.

We cannot permit inspection of these records because they are exempt from disclosure for the following reasons under the Inspection of Public Records Act: including NMSA 1978, § 14-2-1A)(4) (confidential law enforcement records); § 14-2-1(A)(8) (otherwise provided by law), including, but not limited to: NMSA 1978, § 32A-4-1 et. seq. (Abuse and Neglect Act); NMSA 1978, § 32A-4-1 et. seq. (Victim’s Rights); and NM Const. Art. II, § 24 (Rights of Crime Victims). If made public the requested records would seriously interfere with the effectiveness of a criminal investigation or prosecution. Additionally, if produced those records might unfairly cast suspicion on or invade the privacy of an individual accused by not indicted for an alleged criminal offense.
