On January 25, 2018, we received your request to inspect:
Any and all correspondence between the city of Albuquerque and Amazon.com Inc within the past two years.
On that same day, you clarified you “are only seeking the proposal made to Amazon regarding their headquarter location search made by Mayor Berry.” You also confirmed you “are not necessarily seeking emails if the proposal did not happen in that form.”
No one at the City, including Mayor Berry, sent Amazon a proposal regarding their HQ2 request for proposals in any format. However, we understand the intent of your request was to obtain a copy of any proposal possessed by the City which was created in response to Amazon’s HQ2 request for proposals. The City has previously located a handful of responsive records due to criteria specified by other requesters. These few records are exempt from disclosure pursuant to NMSA 1978, § 14-2-1(A)(8) (otherwise provided by law), including, but not limited to: NMSA 1978, § 57-3A-1 et. seq. (Uniform Trade Secrets Act); and Rule 11-508 NMRA (Trade Secrets). For more information regarding the asserted exemptions please refer to the letter from Albuquerque Economic Development Inc. (“AED”) counsel dated January 24, 2018.
