This email will acknowledge completion of your public records request dated August 14, 2018. As my office previously mentioned in our communications from last week, the City needed an additional reasonable amount of time to finish our review of the emails that were identified in the email searches that were conducted based on the following criteria:
Time frame: 12/1/17-7/20/18
Key terms: (“Commander” AND (“termination” OR “demotion” OR “retirement”)) OR “John Sullivan”
Mailboxes searched: Mayor Tim Keller, Sarita Nair, Esteban Aguilar Jr., Mike Geier, Rogelio Banez, John Ross, Mizel Garcia & Harold Medina.
We believe the email search criteria that was used to search for any responsive records for the relevant items was reasonable, and since we have not heard otherwise we assume you agree that the search was reasonable. If you disagree then please indicate that in writing and we will respond accordingly.
The City has completed our review of the remaining emails. We have all of the remaining non-exempt responsive records now available for your inspection or copying. The responsive records have been burned to a cd. You are welcome to inspect the cd free of charge or pay $6.75 for the cd. You may inspect or purchase the disk at the City Clerk’s office located at 600 2nd St. NW, Suite 720, Albuquerque, NM 87102.
As a result of our searches we identified several records that we cannot permit inspection of some of these records because they are exempt from disclosure under New Mexico’s Inspection of Public Records Act. NMSA 1978, § 14-2-1(A)(8) (as otherwise provided by law, including but not limited to NMRA, Rule 11-503 (attorney-client privilege); NMRA, Rule 1-026(B)(5) (attorney work product)). I am therefore denying inspection of those records that are potentially responsive to items #4, #5, #6, and #7 of your request.
Lastly, please be aware there are several hundred emails that in our opinion are not responsive to your request but those emails were identified by the aforementioned email search criteria. If you would like to inspect those seemingly non-responsive emails then please indicate that by submitting a new IPRA request for those emails.
