Dear Mr. Dell’Angela:

 

This email will acknowledge completion of your public records request dated August 27, 2018 (identified as #18-4944). The City has conducted an extensive and exhaustive search for any potentially responsive records that were sought. As you are aware, my office reached out to you in the hopes that you would provide some clarity on two aspects of your request, however, your response which you widely circulated failed to address our issues. My office denies your baseless allegations of misconduct that you asserted in your last communication. Moving forward we will continue to communicate with you in a professional and civil manner, even when you do not extend the same courtesy.

 

With that being said, you may pick up copies of all the responsive records that were located and are known to exist at:

Our hours of operation are 8:00AM – 4:30PM M-F. Provide security with a copy of the attached invoice. Please make payment by cash ($22.00) or billed to your account. Payment may also be made by company check made payable to City of Albuquerque.

 

If you are seeking to inspect the responsive records at no cost, then please contact my office and we will provide more information on the location of that inspection. The inspection may take place either at the aforementioned location, but more likely it will occur at the Office of the City Clerk, located at 600 2nd Street NW, Albuquerque, NM 87102. That office is located on the 7th floor of that building. Please contact the Office of the City Clerk (505) 924-3650 if you have any questions related to the inspection at their office.

 

Lastly, please be aware that the City has produced records that we are not obligated to produce in response to this request, including, but not necessarily limited to, records that are not responsive to your request but that potentially provide you additional insight, records that may not be responsive but that answer your question(s), and records that were created after your request was submitted. See NMSA 1978, § 14-2-8(B) (“[n]othering in the Inspection of Public Records Act shall be construed to require a public body to create a public record.”); see also Office of Attorney General New Mexico Inspection of Public Records Act Compliance Guide, page 32, 8th Edition, 2015 (“[t]he right to inspect applies to any nonexempt public record that exists at the time of the request.”). The City has decided to produce these additional records, even though we may not be obligated to produce under IPRA, because we are committed to transparency and openness.
