On or about September 11, 2018, we received your public records request for the following records:
Please provide copies of reports, CAD records, all audio/video recordings, dispatch recordings including 911 calls, calls from FBI agents (radio and telephone), and citizen calls; regarding APD's response to an FBI shooting on 8/4/17 near the intersection of Lucca Ave. SW and 61st SW. Please include call(s) from citizen(s) regarding persons with guns just prior to the FBI shooting.
We cannot permit inspection of these records because they are exempt from disclosure under IPRA, NMSA 1978, § 14-2-1(A)(4) (confidential law enforcement records); and NMSA 1978, § 14-2-1(A)(8) (otherwise provided by law). If made public the requested records would seriously interfere with the effectiveness of a criminal investigation or prosecution. Additionally, the records detail the methods and procedures a law enforcement agency follows when investigating crimes; the records contain evidence that, if disclosed, would alert potential defendants to destroy evidence, coordinate stories, or flee the jurisdiction. At this time my office is unsure how long we will continue to deem the requested records exempt under the law, however, we encourage you to resubmit your request at a later date.
