On September 17, 2018 we received your request for the following: “Please provide me with any and all records pertaining to an investigation that took place December 2016 in regards to all individuals in the Risk Division to include Peter Ennen, Carmela Little, Brett Frauenglass and any other individuals in the investigation.  This is to include any emails that pertain to the investigation from any department and individuals being investigated or interviewed. Please provide any and all documents related to the total costs for investigation.”

 

We apologize for the confusion on our end. We thought you were seeking a more recent investigation. Based on a second reading and your clarification, my office has conducted a follow-up search. We located a responsive investigation, however, after reviewing the responsive investigation we have determined that we cannot permit inspection of the requested records because they are exempt from disclosure under IPRA, pursuant to NMSA 1978, § 14-2-1(A)(3) (matters of opinion); and NMSA 1978, § 14-2-1(A)(8) (otherwise provided by law), including, but not limited to Rule 11-503 NMRA (Lawyer-Client Privilege), and Rule 1-26 (Attorney Work Product). The city will now close this request.

This will acknowledge completion of your public records request dated 9/17/18 (identified as #18-5329). in which you requested the following:

Please provide any and all documents related to the total costs for investigation.

If you are seeking to inspect the responsive records at no cost, then the inspection will occur at the Office of the City Clerk, located at 600 2nd Street NW, Albuquerque, NM 87102. That office is located on the 7th floor of that building. Please contact the Office of the City Clerk (505) 924-3650 if you have any questions related to the inspection at their office.

 

Alternatively, if you are seeking to purchase a copy of the records, then please know the City charges $6.75 for each CD. Payment may be made by check payable to the City of Albuquerque, and the payment will be processed at the Office of the City Clerk.

Lastly, we cannot permit inspection of some of the responsive records because those records are exempt from disclosure under IPRA, pursuant to NMSA 1978, § NMSA 1978, § 14-2-1(A)(8) (otherwise provided by law), including, but not limited to Rule 11-503 NMRA (Lawyer-Client Privilege), and Rule 1-26 (Attorney Work Product).
