Dear Ms. Kennedy:
This email will acknowledge completion of your public records request dated September 28, 2018 (identified as #18-5601). The City has concluded our search, and my office will produce the non-exempt responsive records that were located after our thorough and comprehensive search. Those responsive records are now available for your inspection. Please also be aware, that my office has determined that some of the responsive public records are exempt under the law.
The request sought production of the following records:
Pursuant to the Inspection of Public Records Act, NMSA 1978 § 14-2-1 et seq., I am writing to request production of any documents, including check stubs, invoices, and any other materials, showing payments or bills to or from the law firm of Hinkle Shanor LLP. This request is limited to those documents created as part of Hinkle Shanor LLP’s work in the case of Cindy Pino, et al. v City of Albuquerque, D-202-CV- 2018-03591.
If you are seeking to inspect the non-exempt responsive records at no cost, then the inspection will occur at the Office of the City Clerk, located at 600 2nd Street NW, Albuquerque, NM 87102. That office is located on the 7th floor of that building. Please contact the Office of the City Clerk (505) 924-3650 if you have any questions related to the inspection at their office. Alternatively, if you are seeking to purchase a copy of the records, then please know the City charges $0.50 per page for paper records, and $6.75 for each CD or $7.99 and up for records on a flash-drive. Payment may be made by check payable to the City of Albuquerque, and the payment will be processed at the Office of the City Clerk.
Lastly, as I previously mentioned, we cannot permit inspection of some of the responsive records because those records are exempt from disclosure under IPRA, pursuant to NMSA 1978, § 14-2-1(A)(8) (as otherwise provided by law); Albuquerque, N.M., Code of Ordinances § 2-8-2-11; see also NMSA 1978, § 15-7-9. Additionally, certain redactions were made to the records that are being produced, those redactions were made pursuant to NMSA 1978, § 14-2-1(A)(8) (otherwise provided by law), including, but not limited to Rule 11-503 NMRA (Lawyer-Client Privilege), and Rule 1-26 (Attorney Work Product).
Thank you again for your continued patience regarding this request. My office will now close out this request.
Please let me know if you have any questions.
