Unfortunately, during our search, my office (APD IPRA) discovered the investigation is being handled by the Bernalillo County Sheriff’s Office. All of the requested records are maintained by the Bernalillo County Sheriff’s Office (“BCSO”). I have forwarded your request to that entity. BCSO is aware of your request, however, to expedite your request, it would be advisable for you to write an additional letter requesting the records to the proper custodian at your earliest convenience. In closing, we apologize for the delay in communicating with you. When we learned that this was a BCSO investigation, we reached out to their records custodian in the hopes of acquiring the responsive police report so we could provide it to you directly. Our goal was to expedite the production process, and get you the responsive record quicker. Unfortunately that did not occur. However, we are certain at the time you submitted your request the City and APD did not have custody or control off the report that you sought. Hopefully BCSO will be able to quickly provide you the report you seek or provide additional details as to why it is not available.
