On 2/1/2018, we received your public records request for the following records:

 

Subject: IPRA Request re Agreements between TCEA and any City of Albuquerque Department(s), Divisions and Sections

This request is made under the City of Albuquerque (CABQ) IPRA.

Background:

The Tanoan Community East Association, Inc. (TCEA) Article of Incorporation (copy attached) states that

"The purposes for which the corporation is formed are:

A. To promote the health, safety and welfare of the owners and residents of the community …"

B. To lessen the burdens of the Governments of the City of Albuquerque…by providing and supplementing City and County services with respect to the community."

C. To construct, own, and maintain streets, and footways, structures and walks within the community"

D. To own, hold and manage all portions of the …"Common Areas"…"

E. To perform any and all acts necessary and proper to promote the health, safety and welfare of the owners and residents of the community and to lessen the burdens of Government with respect thereto, including without limitations any of the following acts:

1. To provide or supplement municipal or utility services, including garbage and trash collection, fire protection and security or police protection;

2. To establish and collect assessments or charges to be levied against the lots and living units located within the community for the purposes of providing such services and maintaining Common Areas.

3. To enforce the provisions of and perform the duties set forth in the Declaration of Covenants and Restrictions of TCEA…

4. To own, acquire, build, operate and maintain streets, footways, commons, parks, landscaping, parking areas and utilities within the common areas

5. To pay taxes, if any, assessed against the Common Areas and to discharge any liens or claims of lien against the Common Areas

6. To Construct and maintain structures or other capital improvements on the common areas and adequately insure same

7. To receive, administer and apply funds generated by assessments for the common benefit of the owners and residents of the Community"

IPRA Public Records Request:

Relative to the background described above please provide copies (in electronic format) of the following public records:

1. Any and all agreements & Memorandum of Agreement (MOA) between TCEA and any/all CABQ department, division(s) and section(s) that permits TCEA to act on behalf of the City of Albuquerque to promote the health, safety & welfare of the TCEA community.

2. Any and all Memorandum of Understanding (MOU) between TCEA and any/all CABQ department, division(s) and section(s) that permits TCEA to act on behalf of the City of Albuquerque to promote the health, safety & welfare of the TCEA community.

 

3. Any and all agreements, MOA and MOU between TCEA and any/all CABQ department, division(s) and section(s) that permits TCEA to assess and collect fees, costs and charges on behalf of the City of Albuquerque for the health, safety & welfare of the TCEA community.

4. Any and all agreements, MOA and MOU between TCEA and any/all CABQ department, division(s) and section(s) for TCEA to provide any aspect of governmental services, health, safety, police, fire, trash collection, welfare, streets, footways, parks, landscaping, parking, utilities, capital improvements and/or charging assessments for such services.

5. Any and all agreements, MOA, MOU and permits between TCEA and any/all CABQ department, division(s) and section(s) that allows TCEA to construct, own, hold, manage and/or maintain streets, and footways, structures, walks and common areas within the TCEA community.

6. Any and all payments, reimbursements and/or credits provided any/all CABQ department, division(s) and section(s) to TCEA and/or its property management company(ies) for promoting, assessing and/or providing any actual governmental services, health, safety, police, fire, trash collection, welfare, streets, footways, parks, landscaping, parking, utilities, capital improvements and/or charging assessments for such services.

7. Any and all payments, reimbursements and/or credits provided by any/all CABQ department, division(s) and section(s) to TCEA community residents and/or property owners for TCEA promoting, assessing and/or providing any actual governmental services, health, safety, police, fire, trash collection, welfare, streets, footways, parks, landscaping, parking, utilities, capital improvements and/or charging assessments for such services.

8. Any and all payments, reimbursements and/or credits provided by TCEA and/or its property management company(ies) to any/all CABQ department, division(s) and section(s) for promoting, assessing and/or providing any actual governmental services, health, safety, police, fire, trash collection, welfare, streets, footways, parks, landscaping, parking, utilities, capital improvements and/or charging assessments for such services.

To reduce CABQ reproduction costs, please send copies of requested documents in electronic form via e-mail to the undersigned. Since public records are already in electronic form, I am requesting this information as gratis. However, if there is cost associated with this request, please send me an e-mail with the amount and instruction for payment; and I will provide the funds.

 

This communication will confirm our completion of your request. We have searched for responsive records and not been able to locate or identify any records. As a result, there are no responsive records related to your request that are maintained by my office. My office will now close your public records request.
