This office requests copies of any requests the City has received pursuant to the Inspection of Public Records Act for records related to the officer-involved shooting at Warren Sandia Apartments on November 4, 2018, or any tort claims notices regarding the same incident.

The City has completed our search and review of all responsive records. We now have the non-exempt responsive records available for your inspection or you may purchase a copy of the non-exempt records. Please be aware, during our search for records related to the portion of your request for “tort claims notices” the City located the tort claims notice submitted by your office, however, that records is not being provided because in addition to the below mentioned exemption it was also not in our custody and control at the time this request was submitted. One additional tort claims notice was located, however, as I mentioned the City determined it is necessary to withhold the production of those record(s) because they are exempt from disclosure for the following reasons under the Inspection of Public Records Act pursuant to NMSA 1978, § 14-2-1(A)(8) (otherwise provided by law), including, but not necessarily limited to the City of Albuquerque’s Risk Management Ordinance, § 2-8-2-11 (CONFIDENTIALITY OF RECORDS).
If you are seeking to inspect the responsive records at no cost, then the inspection will take place either at the aforementioned location, but more likely it will occur at the Office of the City Clerk, located at 600 2nd Street NW, Albuquerque, NM 87102. If you are seeking to purchase a copy, then you can do so at the Office of the City Clerk, the copying costs will be $0.50 per page for paper records, and $6.75 for electronic records on a CD or $7.99 and up for electronic records on a flash-drive.
