This email will acknowledge completion of your public records request dated December 6, 2018 (identified by the City as #18-6999), in which you requested to inspect:

 

 Please accept this as my SUPPLEMENTAL Inspection of Public Records Act request. 

 Please provide us with a complete copy of any and all documents you have related to the accident on May 7, 2018at Wyndham Albuquerque Hotel, 2500 Carlilst Blvd. NE, Albuquerque, NM  87110 involving Muhammed Bashir Bello, investigated by Albuquerque Police Dept., including but not limited to: 

  1. All accident/incident reports regarding the above accident; 
  1. 911 and Dispatch Logs regarding the above accident; 
  1. Any and all photographs and/or video recordings from the Albuquerque Police Dept., Bernalillo County Sheriff’s Office, NM State Police, NM Motor Transportation Division, NM Department of Public Safety and/or any other law enforcement agency regarding the above accident in .jpeg format or similar
  1. Any and all notes, records, documents (including photos and data recordings), electronically stored materials, or tangible items produced by any investigation, test, experiment, or recreation/reconstruction of the accident; 
  1. Any and all statements whether written or recorded; and 
  1. Any and all inspections/examinations of the vehicles involved.

I apologize for the delay in communicating with you. My office had to reach out to several individuals within APD and other City departments to finalize our search, and review of the records. The City has completed our search and review of all responsive records. We now have the non-exempt responsive records available for your inspection, or alternatively you may purchase a copy of the non-exempt records. Please be aware the non-exempt records are largely if not entirely the records that were previously made available to you/your office in the previous IPRA request #18-3329. 

 

Please be aware, my office determined it was necessary and appropriate to withhold the production of certain record(s) which are exempt from disclosure for the following reasons under the Inspection of Public Records Act: including NMSA 1978, § 14-2-1(A)(4) (confidential law enforcement records); § 14-2-1(A)(8) (otherwise provided by law), including, but not limited to NMSA 1978, § 132A-4-1 et. seq.  At this time, my office is unsure how long we will continue to claim these exemptions. Please submit a follow-up IPRA request at a later date if you still desire to inspect any of the records that are exempt from disclosure. Alternatively, you are also welcome to call my office for an update on the case.

If you are seeking to inspect the responsive records at no cost, then please contact my office and we will provide more information on the location of that inspection. The inspection may take place either at the aforementioned location, but more likely it will occur at the Office of the City Clerk, located at 600 2nd Street NW, Albuquerque, NM 87102. That office is located on the 7th floor of that building. Please contact the Office of the City Clerk (505) 924-3650 if you have any questions related to the inspection at their office.

Additionally, my office determined is was necessary to exempt from disclosure some of the requested records for the following reasons under the Inspection of Public Records Act: including NMSA 1978, § 14-2-1A)(4) (confidential law enforcement records); and § 14-2-1(A)(8) (otherwise provided by law), including, but not limited to: NMSA 1978, § 32A-4-1 et. seq. (Abuse and Neglect Act). At this time, my office is unsure how long we will continue to claim these exemptions.
