Dear Mr. Grover:
This email will acknowledge completion of your public records request dated February 6, 2019 (identified by the City as #19-816), in which you requested to inspect:
A copy of the administrative investigative report for Case No. PO1911589. This was an administrative investigation conducted by Robert Caswell & Associates over the course of 2018-2019 and involved City of Albuquerque Department of Transit security personnel including, but not limited to, Melanie Rodriquez and Chris Campbell. Please be sure to include all, but not limited to, the investigation's reports, statements, exhibits, transcripts, audio recordings, video recordings, findings and conclusions, notices, and memos.
Thank you for your patience during this process, and I apologize for the delay in communicating with you. First off, we interpreted your request for the “Robert Caswell & Associate” report as if you were asking for the “Robert Caswell Investigation Inc.” (also known as RCI) report. Please let us know if that interpretation is incorrect. As it stands, the City has completed our search and review of all responsive records. We now have the non-exempt responsive records available for your inspection or you may purchase a copy of the non-exempt records. Please be aware, my office redacted protected personal identifier information contained in those records, pursuant to NMSA 1978, § 14-2-1(B). My office also determined is was necessary and appropriate to redact additional information from the records for the following reasons under the Inspection of Public Records Act: including NMSA 1978, § 14-2-1(A)(3) (matters of opinion); NMSA 1978, 14-2-1(A)(8) (otherwise provided by law), including but not limited to, the City of Albuquerque’s Open Records Ordinance § 2-7-6-2 (home addresses and personal phone numbers of certain City employees).
You may pick up and purchase a copy of the non-exempt records at:
Office of the City Clerk
600 2nd Street NW, Albuquerque, NM 87102.
7th floor of that building.
At your request the Office of the City Clerk can provide you an invoice of the copying costs, however, the typical copying fees are $0.50 per page for paper records, and for electronic records $6.75 for a CD and $7.99 and up for electronic records placed on a flash-drive.
If you are seeking to inspect the responsive records at no cost, then the inspection will take place at the Office of the City Clerk, located at 600 2nd Street NW, Albuquerque, NM 87102. That office is located on the 7th floor of that building. Please contact the Office of the City Clerk (505) 924-3650 if you have any questions related to the inspection at their office.
Thank you again for your patience during this process. My office will now close this request. Please do not hesitate to contact me if you have any questions or comments.
